If you (“Pharmacy”) use the Liberty Sponsored CoverMyMeds’ eVoucher Service you agree to be bound by these eVoucher Terms (“eVoucher Terms”):

The eVoucher Service provides real-time electronic coupons to help reduce patients’ out-of-pocket expenses on select prescription product. This is made possible by Program Sponsors that design various programs for the benefit of patients using the manufacturer’s products.  CoverMyMeds administers and manages this eVoucher Service and can only be used by Pharmacies using CoverMyMeds for switching services.  The eVoucher Service is driven by program sponsors that provide various programs for the benefit of patients using the manufacturer’s products (each “Program”). This program is designed for patients with commercial insurance coverage.

As a condition of access to any CoverMyMeds eVoucher and to be eligible for any fees paid in connection with a eVoucher Program pharmacy shall (i) comply with the terms and conditions applicable to the eVoucher Service, (ii) comply with all laws and regulations applicable to the eVoucher Service and Program, and (iii) secure any authorizations necessary to participate in the eVoucher Service and Program.  The Pharmacy agrees that nothing herein is intended to interfere with a practitioner’s exercise of independent judgment or induce a practitioner to influence choice of any produce that may be paid for, in whole or in part by any program of governmental health care reimbursement.  The Pharmacy agrees to communicate the Program Message to the patient and print the Program Message to be delivered to the patient.

Liberty Software reserves the right to suspend or terminate the eVoucher Service for any or no reason, without liability to Liberty Software.  In addition, if the Pharmacy fails to comply with the terms and conditions of any eVoucher Service or Program, the Pharmacy may be immediately suspended or terminated from participation in the eVoucher Service.  The Pharmacy has the right to terminate the eVoucher Service for any or no reason upon written notice.

Upon reasonable request, Pharmacy agrees that it will allow Liberty or its designee to perform periodic audits of its applicable books and records and submit reasonable documentation to Liberty Software or its designee to confirm Pharmacy’s compliance with any eVoucher Service.  The costs of such audits shall be borne by Liberty or its designee; provided, however, if such audit uncovers a violation of the terms of the Service by Pharmacy, Pharmacy shall be liable for the amount of any amount paid to it in error, plus interest at the lesser of one and one half percent (1 ½ %) or the lawful maximum per month since such error, plus the costs of the audit.

Notwithstanding anything in these eVoucher Terms, or any other agreement between Pharmacy and Liberty Software, Pharmacy hereby authorizes and directs Liberty Software and CoverMyMeds, to access and use its historical and prospective prescriptions claims data for the purposes of (i) analyzing, identifying, designing and/or enabling a Patent Assistance Service; (ii) developing marketing documentation for such services for both program sponsors and Pharmacy (where such marketing documentation will include Pharmacy’s data as detail, but all other Pharmacy data will be aggregated and de-identified in accordance with the Health Insurance Portability and Accountability Act of 1996, as amended); and (iii) providing the program sponsors with reports and information that will be de-identified in accordance with the Health Insurance Portability and Accountability Act of 1996, as amended. In addition, Pharmacy hereby authorizes Liberty or its CoverMyMeds, to include Pharmacy’s name in a list of pharmacies who have agreed to receive eVoucher Services where such list may be provided to potential Program Sponsors.

Liberty may change these eVoucher Terms from time to time and the most current version will always be accessible at https://libertysoftware.com/pharmacyone-legal.  Liberty will notify Pharmacy of such revisions via email.  The current version will become effective 30 days after such notice.  Your continued use of the eVoucher service after such revisions become effective shall constitute Pharmacy’s acceptance of such revisions to these eVoucher Terms.  If Pharmacy does not agree to the revised eVoucher Terms, Pharmacy shall unenroll from the Liberty sponsored eVoucher service.
